This relationship is established between SPANISH HAM and individuals or legal entities, hereinafter referred to as “the CONTRACTOR,” who express their intention to purchase the mentioned products through the request made via the Internet through this website.
These requests by users constitute the specific conditions associated with these General Conditions, which the CONTRACTOR must consult before purchasing the product. The CONTRACTOR is presented with these General Conditions through the website https://spanish-ham.com, so that they may read, print, archive, and accept them. The CONTRACTOR cannot purchase the product without having completed this consultation and acceptance process. By purchasing the products available on this website, the CONTRACTOR declares:
That they are of legal age and have the capacity to contract. That they have read, understood, and accepted these General Conditions. SECOND. APPLICABLE LEGISLATION These General Conditions are subject to the provisions of Royal Decree-Law 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
THIRD. ALTERATION OF THE GENERAL CONDITIONS SPANISH HAM reserves the right to modify these General Conditions at any time, without the need for prior notice to the CONTRACTOR. In any case, it is the CONTRACTOR’s responsibility to review them as a prerequisite for purchasing any product available through this website. In any case, the General Conditions that were posted on the website at the time the CONTRACTOR acquires the corresponding products will be considered valid and applicable.
FOURTH. RIGHTS AND OBLIGATIONS OF SPANISH HAM 4.1. Product Delivery – SPANISH HAM undertakes to deliver the product in perfect condition to the address provided by the CONTRACTOR in the order form, which contains the specific conditions that are attached to these General Conditions. SPANISH HAM will not be responsible for errors in delivery caused by incorrect or omitted data entered by the CONTRACTOR in the order form. The approximate delivery time for each product will be indicated in the purchase confirmation email. In the event that the product is not in stock, SPANISH HAM will inform the CONTRACTOR of the new delivery time by email.
4.2. Responsibility of SPANISH HAM – SPANISH HAM will not be responsible in any case for:
4.2.1. Errors or delays caused by the CONTRACTOR when entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation, or any anomaly that may arise when these incidents are due to Internet network problems, force majeure, or any other unforeseen circumstances beyond the good faith of SPANISH HAM. In any case, SPANISH HAM undertakes to resolve any problems that may arise and to provide all necessary support to the CONTRACTOR to reach a quick and satisfactory solution to the incident.
4.2.2. Errors or damage caused by the CONTRACTOR’s ineffective and bad-faith use of the service.
4.2.3. Non-operability or problems with the email address provided by the CONTRACTOR for the delivery of the order confirmation.
4.2.4. In the event that the product is not in stock or the delivery time is longer than indicated in the product description, SPANISH HAM will inform the CONTRACTOR of the new delivery time by email. If the product selected by the CONTRACTOR is not in stock, they will have the option to cancel their order or have SPANISH HAM replace the product with one of equivalent or superior quality.
FIFTH. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR 5.1. Payment – The CONTRACTOR agrees to pay the amount for the product requested in advance, in the following amount and manner:
5.1.1. Amount – The remuneration for the product requested by the CONTRACTOR will be as indicated on the website and in the specific request of the CONTRACTOR at any given time. These requests constitute the specific conditions of the specific order. The prices of the products displayed on the website always include VAT, unless otherwise stated.
In addition to the price listed on the website for each of the products offered, the relevant shipping costs must be added. SPANISH HAM undertakes to communicate the overall cost of both the product and the shipping costs to the CONTRACTOR prior to finalizing the purchase and in the confirmation email.
5.1.2. Payment Methods – The CONTRACTOR must pay the corresponding amount for the product purchased by credit card, cash on delivery, or bank transfer.
5.2. CONTRACTOR’s Responsibility – In any case, it is the CONTRACTOR’s responsibility to:
5.2.1. Assume all risks of damage, loss, or deterioration of the products from the moment they are made available to them by the third party who, on behalf of SPANISH HAM, delivers the requested products.
5.2.2. Verify the good condition of the package in front of the third party who, on behalf of SPANISH HAM, delivers the requested product, indicating any anomalies that they may detect in the packaging on the delivery note. If, after checking the contents, the CONTRACTOR detects any issues such as breakage or damage caused during shipping, they agree to notify SPANISH HAM as soon as possible.
SIXTH. LIABILITY 6.1. – SPANISH HAM will in no case be liable for:
6.1.1. Errors and incidents that may occur in communications or incomplete transmissions, so the continuous operation of the website’s services cannot be guaranteed.
6.1.2. Any type of damage that the CONTRACTOR or third parties may cause to the website.
6.2. – SPANISH HAM reserves the right to suspend access to the website without prior notice, discretely and permanently or temporarily, until the effective responsibility for the damages that may occur is assured. Likewise, SPANISH HAM will collaborate with and notify the competent authority of these incidents as soon as it becomes aware that the damages caused constitute any type of illegal activity.

Therefore, all reproduction, communication, distribution, and transformation of the protected elements are expressly prohibited without the express and written consent of SPANISH HAM.
EIGHTH. APPLICABLE LAW AND JURISDICTION. These General Conditions are governed by Spanish law. To resolve any dispute or conflict arising from these General Conditions, SPANISH HAM submits to the jurisdictional criteria established in the applicable legislation on consumers and users.
NINTH. In the event that any clause of these General Conditions is declared null and void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these conditions.
